These Terms & Conditions ("Terms") govern your access to and use of the Trash2Cash mobile application, website, discount marketplace, Wallet passes, and related services (collectively, the "Service") provided by Trash2Cash, LLC ("Trash2Cash," "we," "us," or "our"). Please read these Terms carefully. By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old or have permission from a parent or legal guardian to use the Service. You must provide accurate account information, keep your credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account. If you use the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.

2. The Trash2Cash service

Trash2Cash encourages users to safely remove litter and may award points for qualifying cleanup submissions. Users may use eligible points to activate offers provided by participating businesses. Availability, point requirements, locations, exclusions, expiration periods, and other offer terms may vary.

Trash2Cash may use automated systems and human review to evaluate submissions, prevent fraud, and administer rewards. Submitting a photo does not guarantee approval or points.

3. Cleanup safety

Your safety comes first. Do not enter private property without permission, trespass, obstruct traffic, handle hazardous waste, touch sharp objects, approach unsafe areas, or place yourself or another person at risk. Follow applicable laws and use appropriate protective equipment. Trash2Cash does not direct or supervise cleanup activity and is not responsible for injuries or property damage caused by unsafe conduct.

4. Points and rewards

  • Points are promotional units used within Trash2Cash. They are not money, stored value, a bank deposit, or transferable property unless we expressly state otherwise.
  • Points have no cash value and may not be sold, transferred, or combined between accounts.
  • We may reverse points or rewards obtained through mistake, abuse, duplicate submissions, manipulation, or violation of these Terms.
  • Offers are subject to their displayed terms and may be limited by location, time, inventory, purchase amount, or availability.
  • Unless required by law, expired points or rewards are not replaced.

5. Merchant offers

Participating merchants are independent businesses. Merchants are responsible for their products, services, prices, food safety, customer service, legal compliance, and fulfillment of valid offers. Trash2Cash facilitates discount discovery and verification but does not control merchant operations. Displayed offer terms, including eligible locations, exclusions, purchase requirements, and expiration periods, form part of the offer. Contact us if a merchant does not recognize a valid discount so we can investigate.

6. Optional card-linked rewards

Trash2Cash may offer an optional card-linked cashback feature. If you choose to enroll a payment card, the enrollment interface is provided by our card-linking provider, Fidel API. Card information is tokenized and submitted directly to Fidel API. Trash2Cash does not receive or store your complete card number or security code.

By enrolling a card and activating a card-linked offer, you authorize Fidel API and participating card networks to monitor transactions made with the enrolled card at participating merchant locations and to provide relevant transaction information to Trash2Cash for administering the rewards program. You may withdraw this authorization by unlinking the card through the Service or contacting us.

A card-linked reward may require activation before purchase and may be subject to a minimum purchase, maximum reward, time limit, eligible location, eligible card network, and other disclosed conditions. A reward may initially appear as pending after authorization and will not be final until the purchase clears. Refunds, reversals, voids, tips, adjusted totals, and delayed settlement may change or cancel a reward.

Card-network and merchant-identification systems are not error-free. We do not guarantee that every transaction will be detected. If an eligible transaction is missing, contact us with non-sensitive purchase details. Never send us your complete card number or security code.

7. Payments and cashback

Trash2Cash is not the payment processor for purchases made at participating businesses. Your card issuer and the merchant process the underlying payment. Any cashback shown in Trash2Cash is a promotional reward and may remain pending until the qualifying transaction settles. Withdrawal or payout options, if offered, may be subject to identity verification, minimum amounts, processing periods, and additional terms disclosed in the Service.

8. Wallet passes and redemption codes

Trash2Cash may provide Apple Wallet passes, QR codes, barcodes, or promotional codes as redemption tools. These tools do not function as payment cards and do not guarantee acceptance when an offer is invalid, expired, previously used, or unavailable at that location.

9. User content

You retain ownership of photos and other content you submit. You grant Trash2Cash a non-exclusive, worldwide, royalty-free license to host, process, reproduce, and analyze that content as necessary to operate, secure, improve, and promote the Service, subject to our Privacy Policy. You represent that you have the right to submit the content and that it does not violate another person's rights.

10. Prohibited conduct

You may not submit false or recycled cleanup evidence, manipulate location information, create duplicate accounts to obtain rewards, misuse another person's payment card, interfere with the Service, scrape protected data, reverse engineer security controls, harass merchants or users, or use the Service unlawfully. We may suspend accounts, reverse rewards, and preserve evidence of suspected fraud.

11. Third-party services

The Service may depend on third parties such as Fidel API, payment processors, cloud hosting providers, mapping providers, notification services, Apple Wallet, Google services, and participating merchants. Their services and terms may apply separately. Trash2Cash is not responsible for outages or actions outside its reasonable control.

12. Availability and changes

We may modify, suspend, or discontinue features, offers, point requirements, or supported locations. We do not guarantee uninterrupted or error-free operation. We will use reasonable efforts to communicate material changes affecting active rewards.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." Trash2Cash disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

14. Limitation of liability

To the fullest extent permitted by law, Trash2Cash will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, personal injury arising from unsafe cleanup conduct, or merchant products and services. Trash2Cash's aggregate liability relating to the Service will not exceed the greater of $100 or the amount you paid directly to Trash2Cash during the twelve months before the event giving rise to the claim. These limits do not apply where prohibited by law.

15. Indemnification

You agree to indemnify and hold harmless Trash2Cash, LLC and its officers, employees, and agents from third-party claims arising from your unlawful conduct, unsafe cleanup activity, fraud, submitted content, or material violation of these Terms.

16. Suspension and termination

You may stop using the Service at any time. We may restrict or terminate access when reasonably necessary to protect users, merchants, the Service, or the integrity of the rewards program. Provisions that by their nature should survive termination will remain effective.

17. Governing law

These Terms are governed by the laws of South Carolina, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction serving Beaufort County, South Carolina, unless applicable law requires another venue.

18. General provisions

These Terms and the Privacy Policy constitute the entire agreement between you and Trash2Cash concerning the Service, except for any separate written agreement that applies to a participating merchant or another specific program. If any provision is found unenforceable, the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our consent; we may assign these Terms in connection with a merger, financing, reorganization, or sale of all or part of our business.

19. Changes to these Terms

We may update these Terms as the Service or applicable requirements change. We will post the revised version and provide additional notice when required by law. Continued use after revised Terms take effect constitutes acceptance of those Terms.
